1. Introduction

1.1.  These Terms of Service (“Terms”) govern your use of the website owned and operated by Nova Quinta dos Machados – Turismo Rural, S.A. (NIF 503 480 487) trading as Doma Portugal (“Owner,” “we,” “us,” or “our”), located at https://doma.pt (“Website”).

1.2.  By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.

1.3.  We may modify these Terms at any time. Your continued use of the Website after changes constitutes acceptance of the revised Terms.

1.4.  Your use of the Website is also subject to our Privacy Policy and Cookie Policy, which are incorporated herein by reference.

1.5.  Age restriction. The Website is not intended for children under 13 years of age. By using the Website, you confirm that you are at least 13.

2. Definitions

2.1. “User,” “you,” or “your” — any individual or entity that accesses or uses the Website.

2.2. “Content” — all information, text, images, data, links, software, or other material accessible through the Website, whether created by us or provided by users.

2.3. “Member” — a user whose membership application with Doma Portugal has been approved.

2.4. “Services” — all services provided through the Website, including hotel-room booking and membership applications.

3. License Grant

3.1.  We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal or business purposes, subject to these Terms.

4. Intellectual Property Rights

4.1.  All content, designs, trademarks, logos, text, images, graphics, and software on the Website are the intellectual property of Doma Portugal or its licensors and are protected by applicable law.

4.2.  You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content without our express written permission.

5. User Accounts and Membership

5.1.  Hotel-room booking is available to all users and does not require registration.

5.2.  Personal accounts (“personal cabinets”) are available only to Members after membership approval.

5.3.  Accounts are created exclusively through the membership application process; no direct self-registration exists.

5.4.  You must provide accurate, current, and complete information in your membership application and keep it updated.

5.5.  If granted an account, you are solely responsible for:

  a. maintaining confidentiality of credentials;

  b. all activities under your account;

  c. notifying us immediately of unauthorised use.

5.6.  We may disable any account if you breach these Terms or if we believe the account is compromised.

6. Hotel-Booking Services

6.1.  The Website lets any user browse and book hotel accommodations without registration.

6.2.  All bookings are subject to availability and confirmation.

6.3.  By making a booking, you acknowledge that:

  a. you enter a direct contract with Doma Portugal;

  b. booking and payment are processed via the MEWS booking system, a third-party provider;

  c. you accept the specific terms and conditions for your booking;

  d. data processing for bookings and payments is described in §4 and §6 of our Privacy Policy.

6.4.  Payments are completed in MEWS. Doma Portugal does not collect, store, or process payment-card data.

6.5.  We strive for accuracy in property descriptions, amenities, and rates but cannot guarantee completeness or timeliness.

7. Membership Application

7.1.  Users may submit membership applications.

7.2.  Submission does not guarantee acceptance; approval is at our sole discretion.

7.3.  By applying, you:

  a. warrant all information is true and complete;

  b. consent to our contacting you;

  c. acknowledge we may request additional information.

7.4.  If approved, you gain:

  a. a personal account on the Website;

  b. member-specific features and content;

  c. exclusive benefits described in membership materials.

7.5.  The membership process is the only way to obtain a personal account.

8. Permitted Uses

8.1.  You may use the Website only for lawful purposes and in accordance with these Terms.

8.2.  Permitted activities include:

  a. browsing and interacting with content;

  b. making legitimate hotel bookings;

  c. submitting membership applications;

  d. downloading materials expressly marked for download without modification or redistribution.

9. Prohibited Uses

9.1.  You agree not to:

  a. use the Website for unlawful, harmful, or fraudulent purposes;

  b. interfere with Website functionality;

  c. attempt unauthorised access to any part of the Website or related systems;

  d. use any automated means (robots, spiders) without prior written consent;

  e. introduce malicious code;

  f. impersonate us, our staff, or other users;

  g. overload or impair the Website;

  h. harvest information without authorisation;

  i. reverse-engineer any part of the Website;

  j. remove or obscure proprietary notices.

16.1.  These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules.

16.2.  Failure to enforce any right does not constitute a waiver.

17. Dispute Resolution

17.1.  All disputes shall be resolved exclusively in the courts of Portugal.

17.2.  You submit to the personal jurisdiction of those courts.

18. Severability

18.1.  If any provision is held invalid, the remaining provisions remain in effect.

19. Entire Agreement

19.1.  These Terms constitute the entire agreement between you and us regarding the Website and supersede prior agreements.

20. Changes to Terms

20.1.  We may modify these Terms at any time at our sole discretion.

20.2.  It is your responsibility to review the Terms periodically. Continued use after changes means you accept the revised Terms.
